I filed for 485 during July 2007. My 140 was already approved. Due to some problems I quit my employer in August 2007. My previous employer was a desi blood sucker. I was fed up & decided to quit after working for him for 3 years. I applied for H1 transfer with a new employer based on approved 140. I got H1 approval for another 3 years. Currently I am working for the new H1 sponsoring employer. I also received an EAD card based on pending 485 for one year. I didnt notify USICS of job change in July.
I applied for EAD extension this year. The application for EAD extension is pending. I got a following RFE on my 485:
Please state whether or not you are currently working for your I-140 petitioner.

There is possibility that retrogression begins in August. The USCIS maail department will acept only those cases the clerk could manually enter into the system by July 31st and then send all those applications back which he could not enter manually

My son's application was returned for missing check (apparently they lost it) where I noticed the date stamp of Sept 30, 2005 and wrote back to them that it was their mistake. And finally they accepted my son's I485 with an RD of Nov 2005.

You guys still think it is horizontal. This has been discussed so many times with reference to the law; the note in november 2005 visa bulletin; another lawyer who received statistics in chinees overall approvals for 2006 which were going to be close to 7% and you guys still believe this is a gray area.
USCIS today is using the vertical flow...I acknowledge that....
It might be a defendable position in courts ..... My arguement is that the original text of of the law is ambigous enough to mount a challenge...It might not succeed but it is possible to take a shot at it....It is a long shot.....

You have the right to an opinion, after all this is a free country. You have expressed it and some people may not like it. Just care less for them.
But most importantly you need to understand that IV has the immigrant community best interests in mind. After all these are regular folks just like you and me who are doing this voluntarily....and we are reaping the benefits of it.
But again you may have a different idea or opinion which is always welcome for debate. For example i do not support piecemeal legislation(DREAM act) but after hearing IV point of view thats the best shot we have right now. So it made sense to me.
Long story short....IV has our best interests in mind.

Why should we punish people who play by the rules? Charles Oppenheim, Guru of the Visa Office in the State Department, has confirmed what we warned employment-based (EB) immigrants about in our June 2009 newsletter. In previous years, thousands of unused EB-4 and EB-5 numbers "spilled over" into other preference categories. However, greater-than-anticipated EB-4 and EB-5 usage, as well as greater demand in the EB-1 category itself, will create an even greater dearth of available "spill over" immigrant visa numbers in the EB-2 category.
In addition, the DOS has indicated that the EB-1 category for individuals born in India or China may backlog or retrogress later this summer, and may do so again in the coming fiscal year. Predictably, prognostications for the EB-2 category for India and China are also quite grim - in the next month or two, the EB-2 category could become unavailable. In particular, USCIS has indicated that it has about 25,000 EB-2 India cases and "significant numbers" of cases for Chinese nationals that have been reviewed and are simply awaiting visa number availability. With respect to the EB-3 category, the DOS has stated that the worldwide, China and Mexico quotas for the EB-3 category will become available again with the start of the new fiscal year in October 2009, with a projected cut-off date of March 1, 2003 for each. The federal quotas limiting employment-based green card numbers have remained unchanged since 1990, nearly two decades ago. I mean EB2 India will be current with in a year.
vdlroa my friend I couldn't agree less with you on that statement. Eb2 will saturate a lot of visa numbers, and will ultimately benefit our friends in EB3. As per now I believe, we should focus on creating more visibility for our cases, which will eventually help EB3 as well.

REALLY? Is it a coincidence that a desi company owner will usually have 99% of his emploees Indian? Thinking that employment depends only on skills is not realistic. A lot of the networking based on national origin interferes with how at least H1 jobs are landed here. So there is a reason to have rules preventing a monopoly.

Did it occur for a single moment that if some one gets out of the line, the line gets shorter? F Y I, This is NOT about me. This is about every one here. I did not dream of this situation which directly favors some one today. Simply, Not many folks knew it was going to be this bad. Folks who knew, kept quiet telling people that its NOT that bad. There is NOT going to be a single solution that benefits every one involved here. Let it be recapture, country limits or advanced degree exemption. Choice is (y)ours. What ever gave you the idea that EB ROW only wait for 3 years? There's this common misconception flying around here that somehow ROW just cruises by and we get GC handed to us on a platter when in fact up until yesterday EB-3 ROW was just as retrogressed as any other category not to mention that labor (pre PERM) and name check delays affected ROW just as much as everyone else. For instance, my brother, who is EB3-ROW with a PD of Dec 2002... and has been in the US since early 2000 and is still waiting in line...so do the math.
We're all in this crap together, some worse than others... so let's stop with this ROW Vs India & China nonsense. Country quotas are unfair and frankly the entire GC process is unfair and unpredictable... We should aim for solutions that solve this issue in a comprehensive way, not by dividing us even further.

I have filed my 485 on 8th June 2007, My 140 is approved in August 2006.
I have 2 different questions.
I have changed the job on 1st July 2008. Do I need to involve my attorney to file for AC 21? The New job title is "System Administrator" which is the same ONET CODE.
IN the while I have another offer with title as "Sr Systems Analyst".
My labor was applied as "Network Engineer" ONET code 15-1071. Can I switch to a job with title "Sr. Systems Analyst" ONET Code 15-1081.00 or 15-1051.00

I am employed by comp A and have completed 5 yrs on my current H1B. Comp A filed for my I 140 which was approved in Aug 2006. I got a 3 yr extension on that H1B till jul 2010. However, this I 140 was revoked in Jul 2007.
Now I want to do a H1B transfer to comp "B". Can I file for transfer till 2010 July even if the original I 140 is cancelled/revoked? Or am I eligible for only filing for remainder of 1 year?
