As your H-1B has been withdrawn prior to your filing for the H-1B change of employer, you are now out of status. An H-1B withdrawal is technically effective immediately upon receipt by USCIS.
The best bet would be to file for a new H-1B (assuming that you did not exhaust your six years of H-1B time) under the fiscal year cap as this has not been reached.
You should notify your legal counsel of the H-1B withdrawal and see how they want to handle it. While it is true that you are currently not in status, they may have an alternate policy.

You can re-enter from Canada with same I-94 and status as long as trip < 30 days.

Visa Interview: Que on Permission to enter New Delhi Embassy for 2 yr 3 months old Son
I am working in USA. I am planning to travel to India next month and require to apply for USA Visa interview.
I have 2 years and 3 months old younger Son who is born in USA and is a American Citizen holding American Passport.
Could you please shar exp. if he will be allowed to be with us during our Visa Interview in New Delhi Embassy. if Yes. pls let me know if there is any requirement for his entry inside the New Delhi Embassy.

Hi Friends,
I am a green card holder, becoming eligible for citizenship in April 2009. My fianc�e has been in the US for the past 2 plus years on F1. She completes her MS in December this year .We plan to visit our home country in August this year and get married. I thought this was a relatively uncomplicated case till I read in some forum recently that marriage to a permanent resident can be a barrier to being admitted to the U.S. in F-1 status. This is because such a marriage obliterates the "non-immigrant" intent required for F-1 entrants. This could very easily jeopardize her plan to re-enter in F-1 status.
Any thoughts or advice on this? Appreciate all the help.

What is the actual text of the notice you received from USCIS? Can you reproduce that here? What does one mean by "long form"?
Also, what is the deadline given? (Date of notice, and date by which you must respond?)
What do you mean by "meeting for PR"? Were you required to appear for an interview in person for adjustment of status?

The travels in India will help a lot in these matters.
My parents got from ICICI. I also heard that Reliance is good to.
The insurance mainly covers the hospital charges in case of hospital admission. Not that great for office visits.
If the age is more than 60, the insurance is almost doubled..

I know many people have been applying and reapplying for EADs and renewals.
I am trying to see if I can figure out any trends in how they are selecting cases for 2 yr renewals.
Please post your EB category, PD(month/yr is adequate), and approved EAD length. If we get sufficient responses perhaps we can see any trends.

When i heard that little girls question (recorded version in NPR news this morning) and michelle's response of "well, i guess your mom should have 'proper' documents" sounds very interesting. Does she imply that she is not happy to face that question or does she say in a subtle manner that illegals should not be here ?
One more thing to note is that in Maryland, schools "do not" check legal status of children's parents during school admissions.but isn't that atleast an utility bill or rental contract is required as proof of residence? then in that case, how the systems are working here ?
On the other hand, one of my close friend ( 11th year in this country with H1B extension in pending) can not get a driver license despite the fact he is a tax payer, his status is absolutely legal, bought a home few years back, working for a real company, but just can not get his driver's license in Missouri.
What a shame?
In an extraordinary exchange at an event that is usually just a photo op, First Lady Michelle Obama fielded a question from a second grader that really reminds us of the fact that the millions of people in the US working without status today are real people with real families. While the antis choose to dehumanize these folks by portraying them as criminals and parasites, this little girl reminds us that we're talking about people who are faced with terrible choices in life - living in utter poverty in an unstable homeland or living in the shadows in a wealthy...

I came to us on h4 visa . after comming here i joined a university and applied for change of status to f1 and it is approved. I am planning a trip to india. do i need to go to indian consulate for f1 visa? if i have to go wat r the chances of rejecting f1 visa? if my f1 visa gets rejected can i come back on h4 visa? is my h4 visa valid? or do i need to apply for h4 visa again? and if i apply wat r the chances of approval ? please help me i am in a tough situation. please i need ur advise. thank u :)
Since your spouse is in US on H1, do you know if she/he filed for his I-140/I-485. If so, there are chances that your F-1 visa can be rejected on the grounds of "potential immigrant" even though your I-485 is not filed. F-1 can be rejected because your spouse has shown immigrant intent which means you could be a potential immigrant as well.
Otherwise, if you have all the documents (educational background from accredited university, bank statements, valid I-20), you should get your F-1 visa without any issues. If for some reason its denied, then you can use your current valid H4 visa to re-enter US on H4. In that case, you will again roll back to H4 status upon re-entry.

I & My wife are working on H1-B visas currently. We two simulataneously started our Greencard process with our employers.
Both of us have a priority date of Sept 2006 & our EB category is Eb2. Both our labors got approved & applied for I-140s. My wife's I-140 got approved recently (from TSC) while Mine is still pending with NSC (Nebraska dates are behind).
A couple of months back, my current employer offered me a pre-aproved EB3 labor (from April 2004) & asked me to apply for I-140 (Substitute). He told me that once approved, I can port this EB3 2004 priority date onto my Eb2 I140. I applied for the same in premium processing, subsequently got an ability-to-Pay RFE and employer is working on providing audited financial statements from 2004.
Overall, we have 3 I-140s between me (2 pending) & my wife (1 Approved). Now that everything is current which one should we pick for applying I-485....This has become a big puzzle for us.
Here below is a snapshot of our status:
Me - EB2 (Sept 2006) - I-140 Pending
- EB3 (Apr 2004) - I-140 Pending (got RFE)
My wife - EB2 (Sept 2006) - I-140 Approved
Here are the options we could think of -
I know, the safest way is to apply I-485 to my wife's approved I-140. But with the DHS's forecast that retrogression is going to be back anytime around Spetember of this year, I am not sure if applying 485 based on a year 2006's date is any useful!! (We get EAD but we may be struck for years to get the green cards).
Is there an option for both of us to apply for I-485s (I will be dependent on my wife's application & my wife would be dependent on my application). If possible, this option gives us a safety net & also helps us in picking up the best. I know at some point, we have to choose between either of the I-485s but hopefully in a couple of months, we get clarity when both my I-140s are approved.
Or is it possible for me to apply for AOS on my pending EB2 2006 I-140 and then once my other Eb3 I-140 is also approved, Can I port the PDs while my I-485 is pending??
In essence, I am trying to find out a way to take advantage of 2004 Priority date I have (assuming Eb3 I-140 is approved).
Could you please help out, if you have any ideas!!

I think it is apparent that people on this forum are frustrated with media representation and lack of understanding of the problems that our group, and those that we represent, face.
Without wishing to get into general political debates, it is probably a fair assumption that American citizens who are actively part of grassroots activism would be concerned about our situation if they knew about it.
There is a voice in numbers, and I believe it might be a good idea to reach out to organizations such as www.indymedia.com (http://www.indymedia.org/en/index.shtml). This is a main hub, there are various regional versions of the organization.
Just another thought on how to publicize our issues.

I thought u r H1 status since 1st october. Have u started working for the new H1 employer (leaving ur L1 behind).
I'm saying u can move from one H1 comp to another within 30 days without paystubs. If u r not even on H1, then this case doesn't arise. At L1, u can't transfer.
